Terms of Service

These terms set out the rules for using BomaSasa as a landlord, property manager, caretaker or tenant.

1. Accepting these terms

By creating an account, accepting an invitation or using BomaSasa, you agree to these terms and the Privacy Policy. If you use BomaSasa for an organisation or property owner, you confirm that you are authorised to act for them.

2. What BomaSasa provides

BomaSasa provides web-based tools for property, unit and tenant management, invoicing, payment tracking, notifications, onboarding, maintenance requests and related rental operations. Features may change as the service develops, and some integrations may be identified as trials, sandbox services or coming soon.

3. Accounts and authorised users

  • Provide accurate information and keep it reasonably current.
  • Protect passwords, invitation links and tenant portal links.
  • Give staff only the access required for their responsibilities.
  • Notify us promptly if an account or link may have been compromised.
  • Remain responsible for activity carried out through authorised accounts.

4. Landlord and property-manager responsibilities

Landlords and property managers are responsible for the accuracy and lawfulness of tenant, lease, charge and property information they enter. They must have authority to contact tenants, issue invoices, process tenant information and send notices through BomaSasa. BomaSasa does not create the tenancy relationship or decide disputes between a landlord and tenant.

5. Payments and M-Pesa

Rent payments are made through payment services configured by the landlord, including M-Pesa Paybill and STK Push. Unless explicitly stated otherwise, money goes to the landlord's configured payment account and is not held by BomaSasa. Payment status may depend on information received from Safaricom or another provider.

Users should verify unusual, unmatched or disputed transactions against the official payment-provider record before taking action. Sandbox transactions are demonstrations and do not represent real money movement.

6. Fees, trials and cancellation

Current subscription prices and trial terms are shown on the website or in an agreed proposal. We will communicate material pricing changes before they take effect. You may cancel in accordance with the applicable plan, but amounts already due and lawful record-retention requirements may continue to apply.

7. Acceptable use

You must not use BomaSasa to:

  • Break the law, harass another person or send deceptive communications.
  • Upload information you have no right to collect or disclose.
  • Attempt to bypass access controls or gain access to another organisation.
  • Interfere with service availability, security or payment reconciliation.
  • Introduce malicious software or use automated access that harms the service.

8. Availability and third-party services

We work to keep BomaSasa reliable, but uninterrupted availability is not guaranteed. Internet connectivity, mobile networks, M-Pesa, email, SMS and cloud providers are operated by third parties. Their outages, delays and terms may affect parts of the service.

9. Intellectual property

BomaSasa and its software, branding and original content remain protected by applicable intellectual-property law. Users retain rights in the information they submit and give BomaSasa the limited permission needed to host, process and display it for the service.

10. Suspension and termination

We may restrict or suspend access where reasonably necessary to address security, unlawful use, serious breach, non-payment or risk to another user. Where practical, we will give notice and an opportunity to resolve the issue.

11. Liability

BomaSasa provides operational software and does not replace legal, accounting or financial advice. To the extent permitted by law, we are not responsible for indirect loss, lost profits, landlord-tenant disputes, or losses caused solely by inaccurate user data or unavailable third-party services. Nothing in these terms excludes liability that cannot lawfully be excluded.

12. Governing law and contact

These terms are governed by the laws of Kenya. The parties should first try to resolve a dispute through good-faith discussion before pursuing available legal remedies. For questions about these terms, email robamanwa@gmail.com.

13. Changes to these terms

We may update these terms as the product or law changes. Material changes will be communicated through the service or an available contact channel. Continued use after the effective date of an update means the revised terms apply.
